CHERRIES DOCKED 17 POINTS
CHERRIES will start life in League Two with a 17-point deduction, the Football League has confirmed.
In the past few minutes, the league has announced the points deduction, which the club must agree to by midday tomorrow.
The club must also pay its creditors the original dividend offered at the Company Voluntary Arrangement (CVA) meeting earlier this year, understood to be around 10p in the pound.
The statement read: "At its meeting this evening, the Board of Directors of The Football League considered an application from a company - AFC Bournemouth (New Co.) - which has applied to join League Two in place of the existing club, which is currently in administration.
"AFC Bournemouth (Old Co.) has been unable to agree a Company Voluntary Arrangement (CVA) with its creditors and as a consequence is unable to satisfy the normal conditions of the league's insolvency policy for exiting administration.
"The Board decided, however, that it was prepared to exercise its absolute discretion under the 'exceptional circumstances' provisions of its insolvency policy. Therefore, in accordance with recent precedent, the Board has made the following offer to AFC Bournemouth (New Co.). Acceptance of the Board's offer is a pre-requisite to the exercise of that discretion:
1. The club will be deducted 17 points for the 2008/09 season. This takes into account the fact that the club has had a previous insolvency event.
2. The club must provide a legal waiver indicating that it will not challenge or appeal this decision.
3. The club must pay unsecured creditors the amount offered at the time of the CVA hearing.
"The Board's offer is subject to the club agreeing these conditions, and formal agreements being signed, by 12.00 noon tomorrow."

Can someone explain to me why we've been hit with -17 and Weeds 'only' got -15 last year?
If this year on year points deduction increase continues, does that mean that in 15-20 years time, teams could start on -126 points? (42 games)!!!

As it has already been stated ‘it could have been lot worse’ lets get behind the team now and get the 17 points deficit out of the way and start climbing the league table. It will require courage and determination from all concerned and as a long time supporter I am willing to shout for he boys lets hope more people in Bournemouth come out of their comfortable armchairs and start supporting the team once more. As someone who originated from Italy I am often accused of being unpatriotic for supporting England first before Italy and I also believe that my loyalty should be for my local team first and foremost. Don't start all that up again, we have football Saturday that should be enough without trying to stir up another argument, I was only commenting on the bottom 3 as they are the ones with points deducted and therefore it should be a forgone conclusion that we don't have to think about relegation, as for where we end up let's get those points back first and then see shall we.

Just looking though some past league tables, 2nd bottom team has gained anything between 29 and 47 points in recent seasons. We could need as much as 65 points on the pitch to survive in a worst case scenario. That's 'nearly flirting with the playoffs' form or upper mid table - hopefully we can manage that. Fingers crossed!

If we can win say 5 of our first seven matches, even if we lose 2 we could be only five or six points behind these teams and they will start feeling the pressure.
Saturday is so important we must go for the three points and set the tone for our season.

You are absolutely right Jim.Normally half a dozen clubs start slowly and we need to gain early wins to put pressure on those who do have a poor start.
If we can win say 5 of our first seven matches, even if we lose 2 we could be only five or six points behind these teams and they will start feeling the pressure.
Saturday is so important we must go for the three points and set the tone for our season.

I will be supporting the team home and away this season. But I do not expect much from the management. We won those matches at the end of last season because of the will of the players and despite the manager's lack of ambition. Bond's record is one of overall failure.

-17 isn't unsurmountable and you do currently have 2 other teams on minus points which is a bonus for you as you'll be spurred on by their results and vice versa as none of you would want to be cast adrift. It should mean you catch the others up quicker.....
Personally, I don't think the 2 teams that go down will be from the 3 starting on minus points, at least 1 of you will escape if not 2. I think you have a good blend of youth and experience, Igoe and Anderton are a bonus in midfield but you have to ensure that you take the chances that they create. I am confident that you'll survive this season comfortably in mid table. My only concern is that you haven't got the cover in goal or the experience and you could do with an additional proven striker. Apart from that I think your squad is as good as it can be given your current circumstances.
Anyway here's hoping for a good start, I have Anderton and Pittman in my Daily Telegraph dream team so a hat-trick on the opening day would do nicely! Good luck for the season, stop the sniping and enjoy your football - you've still got a club to support!!!!

richard.board - there is no special requirement for extra payment tomorrow - the CVA money will be paid over a period probably - so there should be no further problems.
Just very grateful it was not worse and pleased they have satisfied the league about funding for the season which was the biggest worry.

I can't wait for the action to begin!! Hopefully the players will continue from where we left off, it will be hard though, our last taste of league two got off to an awful start, but under Bond, I think we can mix it up with teams better, so hopefully it won't take too long to adjust to life in the basement!!! Will everyone stop seeing the negative all the time!!! We've got a 17 point deduction. Just be gratefull we are not in the boots of Luton Town supporters - I know their situation was different but the Football League couldn't give a s**t about any of the teams in the Football League and because everything is done "at the discretion of the FL board", they could of given the same number of points deducted as Luton.
Give Kevin a chance, I beleived he should have gone last season but we are stuck with him and he has improved the team that he had at the start of the last season throught to the end.
Leeds made the playoffs after being on -15. We have a squad that can beat League 1 teams as we proved last season: If we can beat Swansea(1-2), Doncaster (1-2), Leyton Orient(3-1), Tranmere(2-1)...all of which were at the top end of the table, then we can beat the teams in League 2 and overcome a 17 point deduction to at least finish in the top half!!!
You can't expect a miracle. No one expected a miraculous escape from relegation last season but we nearly got it. Give it time and we will be back in league 1.

if we had settled the CVA upfront we would have had no points deducted.
All we have done is get the 17 points deducted and still have to settle the CVA.
Surely Mostyn/Krasner knew this since the FL have been consistent on this since Leeds last season?
As S-6 said they have funds to pay the CVA, if need be, we seem to have been hit for 17 points for no value at all.
Given the CVA is paid over a period of time then why not do this before today?
Anyway I think the deduction will bind the team together and as long as we dont sell Jo to pay for the CVA, I think we will do well.
Given the credit crunch, I reckon 2 more teams will be in admin before the end of the season.

When West Ham used an ineligible player (Tevez) and managed to stay in the Thatcher League (so called because it is based on greed and not giving a f*** for anybody else) becaues of this they were just fined by the FA, I am sure they were delighted. Why were they only fined - because they are a big boy, they threatened legal action if anything affected their TL status and money rules. As somebody very famous (forget who) once said laws are like a spiders web they cactch the flies but let the wasps and hornets through!

I was in two minds to go on saturday as I have to take the other half to gatwick but this situation starting on -17 has led me to think that if I can do my bit and shout and scream and go along then hopefully the players and do theirs on the pitch. I'm looking forward to Aldershot away the week after - remember those 70's days local derbys , jumpers for goalposts..... i've got my ticket already.
I was in two minds to go on saturday as I have to take the other half to gatwick but this situation starting on -17 has led me to think that if I can do my bit and shout and scream and go along then hopefully the players and do theirs on the pitch. We have been given the same points as Rotherham as both clubs have been in administration twice in 'recent years' as the FL put it. It does not matter if we paid off our last cva or not. Leeds only got 15 as it was their first admin. Also, we only have to pay what we previously offered to the creditors, approx 10p in the pound. To have not had any points docked, we would have had to agree a cva with the creditors, and knowing the Inland Rev and others involved, this would have taken at least 80p in the pound or more, which no new owner was ever going to fund, so we take the hit. At the forum, S6 said there was funds in place to pay the cva offer if the FL imposed it, but I assume the 10p in the pound will have to be paid in full straight away as the FL imposed it as a condition of the new company. Lets be honest, if this was any other business other than a football team, we would have been shut down as there are no 'exceptional circumstances' anywhere else !!. I was speaking with the new owners last night whilst I queued for 2.5 hrs for my season tickets, and he said the stuff that the FL wanted between Wednesday's statement and yesterday was not financial and the club would make a full statement to explain, but wanted to wait until he had the golden share in his hand. Must say the players and staff in the ticket office did a great job last night under difficult circumstances. Kate deserves a big bunch of flowers !! UTCIAD

Just a thought. Many of you are whingeing about the FL imposing a 17 point deduction. But what about the many local businesses who will only get 10p in the pound from AFCB???? With the threat of a points deduction badly run football clubs will not have an incentive to put their finances in order. Not all lower league clubs are badly run like AFCB.

The FL know nothing about insolvency and are making up the rules as they go along. You do not need a CVA to exit administration as there are a number of other options for the administrator.

Although you have got a 17 points deduction to start the season off, I actually believe you will turn it around and will still be in the league at the end of the season. Remember what Leeds did last season. Be positive and good luck. PS I am a Northampton Town supporter.

17 points is ridiculous. What's the Point of doing this? It just makes everything harder...help the Team not hinder them! Why doesn't the FA deduct points from Man utd or Arsenal for earning too much money?
